  • Chapter 1: Chapter: The prohibition of divorcing a menstruating woman without her consent; If a man breaks this rule, it still counts as a divorce, and he should be ordered to take her back

باب تَحْرِيمِ طَلاَقِ الْحَائِضِ بِغَيْرِ رِضَاهَا وَأَنَّهُ لَوْ خَالَفَ وَقَعَ الطَّلاَقُ وَيُؤْمَرُ بِجْعَتِهَا

وَحَدَّثَنِيهِ يَحْيَى بْنُ حَبِيبٍ، حَدَّثَنَا خَالِدُ بْنُ الْحَارِثِ، ح وَحَدَّثَنِيهِ عَبْدُ الرَّحْمَنِ بْنُ، بِشْرٍ حَدَّثَنَا بَهْزٌ، قَالاَ حَدَّثَنَا شُعْبَةُ، بِهَذَا الإِسْنَادِ غَيْرَ أَنَّ فِي، حَدِيثِهِمَا ‏"‏ لِيَرْجِعْهَا ‏"‏ ‏.‏ وَفِي حَدِيثِهِمَا قَالَ قُلْتُ لَهُ أَتَحْتَسِبُ بِهَا قَالَ فَمَهْ ‏.‏

This hadith has been narrated on the authority of Shu'ba with the same chain of transmitters but with a slight variation in wording.
